Anti-Spam Policy – SIONIQ

Introduction and Overview
This Anti-Spam Policy (“Policy”) outlines Sioniq’s rules for using our ERP platform’s messaging features, including email, SMS, WhatsApp, push notifications, and CRM tools. We prohibit spam to protect users, recipients, and our platform’s integrity while ensuring compliance with applicable laws and regulations governing electronic communications.
Purpose and Scope
The purpose of this policy is to:
- Prevent misuse of Sioniq’s communication tools
- Protect recipients from unsolicited or harmful messages
- Ensure compliance with applicable anti-spam laws
- Maintain platform reputation and deliverability
This policy applies to: Email campaigns, SMS and WhatsApp communications, Push notifications, CRM-based messaging, Any third-party messaging integrations used via Sioniq.
Definition of Spam
The purpose of this policy is to:
- Prevent misuse of Sioniq’s communication tools
- Protect recipients from unsolicited or harmful messages
- Ensure compliance with applicable anti-spam laws
- Maintain platform reputation and deliverability
This policy applies to: Email campaigns, SMS and WhatsApp communications, Push notifications, CRM-based messaging, Any third-party messaging integrations used via Sioniq.
Consent and Permissions
Users must ensure that:
- Communications are sent only where lawful consent or other valid legal basis exists under applicable law.
- Consent is recorded and auditable
- Communications sent comply with applicable laws (email, SMS, WhatsApp)
- Implied or assumed consent is not acceptable unless permitted by law.
Prohibited Practices
The following activities are strictly prohibited:
- Sending messages to contacts without permission
- Forging headers or sender information
- Bypassing unsubscribe mechanisms
- Sending malware, phishing, or scam content
Unsubscribe & Opt-Out
All communications must clearly identify the sender, provide a visible and functional unsubscribe mechanism and honor opt-out requests promptly. Failure to honor opt-outs is considered as a violation.
User Responsibilities
Users are responsible for:
- Lawful collection of contact data
- Compliance with local and international anti-spam laws
- Message content legality and accuracy
- Managing recipient preferences
Sioniq does not validate or approve message content in advance. Sioniq acts solely as a technology service provider and does not control or initiate communications sent by Customers. Responsibility for ensuring lawful messaging practices rests entirely with the Customer.
Indemnification: Customers agree to indemnify and hold harmless SIONIQ from any claims, penalties, damages, or regulatory actions arising out of Customer’s violation of applicable anti-spam or data protection laws.
Monitoring & Enforcement
SIONIQ does not undertake an obligation to actively monitor all communications. Monitoring, where conducted, is limited to protecting system integrity and ensuring compliance.
SIONIQ may suspend or restrict messaging features where reasonably necessary to protect platform integrity or comply with legal obligations.
Enforcement actions will be proportionate to the severity and frequency of violations.
In the event of investigation, SIONIQ may preserve relevant communication logs in accordance with applicable law.
Consequences of Violation
Violations may result in temporary suspension or permanent account termination or loss of data or messaging privileges or reporting to service providers or authorities. Refunds, if any in cases of policy violations, shall be governed by the applicable Cancellation & Refund Policy.
Third-Party Services
Users integrating third-party messaging platforms remain responsible for their compliance obligations, platform-specific messaging rules and regulatory adherence.
Limitation of Liability
Liability, if any, arising under this Policy shall be subject to the limitations set forth in the “Terms of Use” policy.
Reporting Violation
Users are encouraged to report the policy violations, or security concerns to info@sioniq.com.
Policy Updates and Governing Law
Sioniq reserves the right to modify, supplement, or amend this Policy at any time. Continued use constitutes acceptance of the policy.
This Policy shall be governed by and construed in accordance with the laws of India. All disputes arising under or related to this Policy shall be subject to the exclusive jurisdiction of the courts located in India, specifically in Hyderabad, Telangana.
Acknowledgment
By accessing or using Sioniq services, you acknowledge that:
- You have read and understood this entire Policy.
- You agree to comply with all terms and conditions set forth herein.
- You understand the consequences of policy violations.
- You will immediately cease any activities that violate this Policy upon notice from Sioniq.
- You have the authority to agree to these terms on behalf of your organization.
